• Outbound channel account credentials and access tokens provided as part of service delivery
• Billing information processed through our payment provider
• Communications and correspondence with our team, including via your dedicated Slack Workspace
• Onboarding information such as your ideal customer profile, messaging preferences, and campaign objectives

We also collect certain information automatically when you visit our website, such as IP address, browser type, pages visited, and time spent on the site.

3. How We Use Your Information

We use the information we collect to:

• Deliver, manage, and improve our B2B appointment setting and reply handling services
• Communicate with you about your account, campaigns, replies, and booked meetings via your dedicated Slack Workspace
• Operate the outreach automation, isolated browser profiles, and network infrastructure required to execute campaigns on your behalf
• Process payments and manage billing
• Comply with legal obligations and resolve disputes
• Send service-related updates and, with your consent, marketing communications

4. Account Access & Tool Usage

Our appointment setting service may require access to outbound channel accounts you designate. We access these accounts solely to execute outreach campaigns, manage replies, and book meetings as defined in your service agreement. We do not sell, share, or use your credentials for any purpose beyond service delivery.

To protect account integrity, all activity is conducted through:

• A dedicated, isolated browser profile assigned exclusively to your account
• Geo-matched network infrastructure aligned with your working location
• Industry-standard outreach automation tooling, operated within each channel's usage guidelines

Where we operate dedicated personas or sender profiles on your behalf, those profiles and their associated credentials are owned and operated by Cold GTM for the duration of the engagement.

5. Information Sharing & Subprocessors

We do not sell your personal information. We may share data only in the following circumstances:

• With the subprocessors listed below, who process data on our behalf under written contractual safeguards
• When required by law, regulation, or legal process
• To protect the rights, property, or safety of Cold GTM, our clients, or others
• With your explicit consent

Current subprocessors:

We will provide 30 days' advance notice by email (and on this page) before adding or replacing a subprocessor. Clients may object in writing; we will work in good faith to resolve the concern or, if not resolvable, allow termination without penalty.

6. Security & Retention

We implement industry-standard security measures including encrypted storage, access controls, principle-of-least-privilege credentials, and secure transmission (TLS 1.2+). Account credentials are stored in an encrypted vault accessible only to assigned team members.

Retention periods:

• Onboarding questionnaire & campaign data: duration of engagement + 90 days
• Outbound activity logs & message archives: 90 days after termination
• Billing records: 7 years (tax/accounting compliance)
• Backups: rolling 30-day window

After the retention period, we delete or irreversibly anonymise your data.

7. Your Rights (GDPR / CCPA / UK-DPA)

Depending on your jurisdiction, you have the right to:

• Access : request a copy of personal data we hold about you
• Correction : request correction of inaccurate data
• Erasure : request deletion (subject to legal-retention exceptions)
• Portability : receive your data in a machine-readable format (JSON/CSV)
• Restriction / Objection : limit or object to specific processing activities
• Withdraw consent : for marketing communications, at any time
• Lodge a complaint : with your local supervisory authority

8. Cookies & Tracking

We use a small number of cookies and similar technologies on coldgtm.com:

• Strictly necessary : session, CSRF tokens (always on)
• Analytics : aggregated page-view metrics; loaded only after consent in the EU/UK
• Calendly : booking widget (loaded when you scroll to the call-to-action)

You can change your preferences anytime via the "Cookie settings" link in the footer, or by clearing cookies in your browser. We do not use advertising or cross-site tracking pixels.

9. Data Breach Notification

If we become aware of a security incident affecting your personal data, we will notify you without undue delay and in any case within 72 hours of confirmation, in line with GDPR Article 33/34. The notification will include what data was affected, likely consequences, and the steps we are taking to contain and remediate the incident.

We may update this Privacy Policy from time to time. Material changes will be announced by email at least 14 days before taking effect.

1. Acceptance of Terms

By engaging Cold GTM's services or accessing our website, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

These terms constitute a legally binding agreement between you ("Client") and Cold GTM ("Company"). We reserve the right to update these terms at any time, with changes effective upon posting.

2. Services

Cold GTM provides done-for-you B2B appointment setting and lead generation services. Engagements are structured around qualified meetings delivered, on terms agreed in the engagement documentation.

A typical engagement includes:

• Ideal customer profile definition and list building
• Multi-channel outbound sequences written and executed on your behalf
• Same-business-day reply handling (9AM to 5PM CST)
• Meetings booked directly on the calendar you designate
• A dedicated Slack Workspace for ongoing communication

The specific scope of services for each engagement is defined in your onboarding documentation. We do not promise specific numbers of leads, meetings, or revenue outcomes. Results depend on factors including target market, offer quality, messaging, and channel compliance. We reserve the right to refuse service to any entity at our discretion.

3. Billing Terms

Billing terms, rates, and payment cadence are defined in your engagement documentation. All fees are in USD unless otherwise stated.

• All fees are non-refundable unless otherwise stated in writing
• Late or failed payments may result in service suspension
• Billing terms are subject to change with 30 days' written notice

4. Client Obligations & Indemnity

As a client of Cold GTM, you agree to:

• Provide accurate information during onboarding, including your ideal customer profile and campaign objectives
• Grant us the access necessary to deliver the service, including outbound channel account access where applicable
• Respond to communications and updates through your dedicated Slack Workspace in a timely manner
• Not use our services for unlawful, deceptive, or spam purposes
• Warrant that your offerings, messaging, claims, and target audience comply with the terms of service of any outbound channel used in campaigns and with all applicable laws in your jurisdiction (including CAN-SPAM, GDPR, ePrivacy, TCPA where relevant)
• Notify us promptly of any issues or concerns with campaign performance

Indemnity. You agree to indemnify and hold Cold GTM harmless from any third-party claim, loss, or damages (including reasonable legal fees) arising from: (a) content, offers or claims you provide for use in campaigns; (b) your breach of any outbound channel's terms or applicable law; (c) your misuse of meetings, leads, or contact data generated by the service. This obligation survives termination.

5. Limitation of Liability

To the fullest extent permitted by law, Cold GTM shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to loss of revenue, loss of data, or third-party account restrictions imposed on outbound channels used in campaigns.

Our aggregate liability to you for any claim arising from these terms or the services shall not exceed the total fees paid to Cold GTM in the six (6) months preceding the claim.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

6. Termination

Either party may terminate the service agreement with 30 days' written notice. Cold GTM may terminate immediately if you breach these terms or engage in conduct that violates applicable law or the terms of service of any outbound channel used in campaigns.

Upon termination, all outstanding fees become immediately due. We will return any account access provided to us and delete your data in accordance with our Privacy Policy.

7. Data Processing Agreement (DPA)

Where Cold GTM processes personal data on your behalf (in particular for EU, UK, or Swiss residents), we act as a data processor and you act as the data controller. A standalone Data Processing Agreement incorporating the EU Standard Contractual Clauses is available on request from [email protected] and, once countersigned, forms part of your service agreement.

Where Cold GTM determines purposes and means of processing (e.g., our own marketing contacts, billing), we act as an independent controller under the terms of our Privacy Policy.
